Terms of Use

1. Introduction

KTR Web Works, operating under the brand name BrainBuzz Academy (“we”, “us”, “our” or the “Company”), provides guidance and preparation resources for the Civil Services Examination conducted by UPSC (Union Public Service Commission), State Public Service Commission examinations (including APPSC and TGPSC), and other competitive examinations conducted by agencies such as SSC, RRB, IBPS, SBI and RBI, along with Defence and Teaching examinations. We may expand our services to other educational offerings from time to time.

These Terms of Use (“Terms”) apply to the services made available at brainbuzzacademy.com (the “Website”) and the BrainBuzz Academy mobile application (the “App”) available on Google Play and other app stores. The Website and the App are collectively referred to as the “Platform”. Please read these Terms thoroughly before using the Platform, as they govern your use of the Platform and any other applications, products and services owned and managed by the Company.

For the purpose of these Terms, “You”, “Your” or “User” means any natural or legal person who browses the Platform or registers on it using login credentials, through a computer, mobile, tablet or any other device.

We reserve the right to amend these Terms at any time. Updates will be posted on this page, and we will endeavour to notify you of significant changes. Please review these Terms periodically; continued use of the Platform after changes constitutes acceptance of the updated Terms.

2. Acceptance of Terms

These Terms constitute a legally binding contract between you and the Company. By accessing or using the Platform — even if you only browse or review our free offerings — you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.

In consideration of your use of the Platform, you agree:

• To provide true, accurate, current and complete information about yourself during registration, and to keep it updated
• That it is your responsibility to ensure you meet the eligibility criteria of any examination you are preparing for; BrainBuzz Academy is not responsible for verifying your exam eligibility
• To obtain the consent of your parents or legal guardian before providing any information if you are a minor
• That we are not responsible or liable for any consequences arising from misuse of the Platform by you that causes harm or injury to a third party
• That we reserve the right to review, update, add, remove or replace content and features of the Platform (including test series, videos, notes and current affairs) at any time, and content from earlier editions may not be available in later editions
• That we may engage, change or replace any faculty or content contributor at any time without prior notice

If you provide information that is untrue, inaccurate or incomplete, or we have reasonable grounds to suspect so, we reserve the right to suspend or terminate your account and refuse current or future use of the Platform.

This document is an electronic record under the Information Technology Act, 2000 and the rules thereunder, and does not require any physical or digital signature.

3. Eligibility

Persons who are competent to contract within the meaning of the Indian Contract Act, 1872 are eligible to register on the Platform. If you are a minor, use of the Platform must be made available to you by your parent or legal guardian, who agrees to these Terms on your behalf. Where a minor uses the Platform, it is assumed that such consent has been obtained.

4. Registration and Types of Users

You may browse limited free content as a visitor. To access the full range of services, you must register an account using your mobile number (verified via OTP) or Google account, becoming a Registered User with access to free content.

If you purchase a subscription (such as BrainBuzz Pass) or an individual product, and your payment is received in full, you become a Subscribed User with access to the paid services for the chosen duration. After payment you will receive confirmation on your registered mobile number and/or email.

We may, where required, ask you to submit a valid Government-issued identity proof for verification before granting or continuing subscribed access.

5. Services

“Services” include, without limitation, mock tests and test series, daily quizzes, current affairs articles and compilations, study materials and notes, video courses (recorded and live), performance analytics, and bilingual content in English, Telugu and Hindi, accessible to you based on your user type. Services and their pricing may differ between users based on the plans and combinations chosen.

We may add, remove or modify Services and revise pricing at our sole discretion. We may also terminate or restrict your access to all or part of the Platform at any time, with or without notice, where these Terms are violated.

6. Account, Password and Security

You are entirely responsible for maintaining the security and confidentiality of your account and login credentials. Sessions on the Platform are limited to one active device at a time. We will not be liable for any loss you incur as a result of a third party using your account, with or without your knowledge; you may be held liable for losses incurred by us due to such use. If you suspect your account is compromised, change your credentials immediately or contact support.

7. Payment Terms

• All fees, including GST and any applicable delivery charges, are shown before you complete an online payment. All prices are in Indian Rupees (INR).
• Payments are processed through third-party payment gateways (currently Razorpay). We are not responsible for payment failures or errors arising from technical issues at the bank or payment gateway; such issues must be resolved between you and the concerned bank or gateway.
• In the unlikely event that a fee is displayed incorrectly due to a technical error, we will notify you through your registered email or phone number, and you may be required to pay the difference to continue accessing the Services.
• Access to paid Services is contingent upon our receipt of cleared funds. If any amount due is not paid, we reserve the right to suspend your access to the concerned Services.
• Refunds and cancellations are governed by our Refund Policy.

8. Study Materials Disclaimer

• “Study Materials” include videos, test series, MCQs, notes, current affairs and any other learning material made available on the Platform.
• We do not represent or guarantee that Study Materials, whether free or paid, will be error-free. We strive for accuracy but errors may occur.
• MCQ counts and content are updated continuously (additions and removals) at our sole discretion without prior notice.
• We do not guarantee any rank, marks, selection or professional advantage from the use of the Platform. Success in competitive examinations depends on multiple factors beyond our control.
• Content may be revised in the form of new “Editions” on a yearly, half-yearly or monthly basis; content or features of previous editions may not be carried forward.

9. Subscription and Access Terms

A subscription is personal to you. You shall not transfer, share, resell or allow access to your subscription to any other person, whether for consideration or otherwise. Such acts are a breach of these Terms, and we reserve the right to suspend or terminate your account with or without prior notice.

10. System Requirements

It is your responsibility to ensure the device you use is compatible with the Platform. Minimum requirements: Android 8.0 or above for the App; latest versions of Chrome or Firefox recommended for the Website. We cannot be held responsible for technical problems on devices that do not meet these requirements or arising from circumstances beyond our control.

11. Technical Support and Access

We do not warrant uninterrupted or error-free operation of the Platform. We are not responsible for delays or disruptions caused by internet or network failures, viruses, firewall restrictions on your network, telecommunication failures, browser issues, DRM protocols preventing media playback, or devices not meeting minimum requirements.

12. Communications

By registering on the Platform, you authorise us to contact you via email, phone call, SMS, WhatsApp or push notifications to provide service updates, product knowledge and promotional offers, notwithstanding your registration under DND/DNC/NCPR, for up to 365 days from your registration. By registering a postal address, you consent to being contacted via post or courier for delivery of materials or service updates.

13. Data Protection

We process your information in accordance with these Terms and our Privacy Policy. We may conduct online surveys to improve our services and may share non-personal, aggregated information with third parties. By using the Platform, you consent to such use of your information.

14. Fair Usage and No-Sharing Policy

• A BrainBuzz Academy account is meant to be used by only one user.
• Sharing account credentials for personal or commercial purposes will result in account blockage without prior notice.
• We track usage parameters to identify account sharing. If usage patterns suggest sharing, the account will be placed under scrutiny and investigated.
• A violation of this policy amounts to a substantial breach of these Terms and may result in permanent account termination and legal action as provided under law.

15. Prohibited Conduct

You agree not to host, display, upload, modify, publish, transmit, distribute, share or store any material, or to cut, copy, decompile, reverse engineer, recreate, or create derivative works from any information or software obtained from the Platform. In particular, you shall not:

• Violate any applicable law or regulation, or infringe any copyright, trademark, trade secret or other intellectual property or privacy rights
• Copy, screenshot, screen-record, download or redistribute test questions, answers, explanations, videos or notes in any form
• Use automated tools, bots or scripts to access the Platform or extract content
• Attempt to access the underlying software or source code, or build a competing product using the Platform
• Upload or transmit viruses, malware or any code designed to disrupt the Platform or other users' systems
• Post content that is harmful, harassing, defamatory, obscene, hateful, or that harms minors, impersonates another person, or threatens the unity, integrity, defence, security or sovereignty of India
• Publish or make available any Study Material on any other medium, or mirror or frame the Platform without our express written approval

16. Account Blocking

Your account may be blocked, with or without notice, for reasons including but not limited to:

• Suspicious activity or suspected fraud
• Use of rooted or jailbroken devices, emulators, cloned APKs or virtual machines
• Screen casting, screen recording, screen mirroring, or downloading videos outside the Platform
• Using a camera, phone or any other device to record Platform content
• Sharing Platform screenshots, PDFs or content on social media or any other network
• Sharing account credentials with anyone, or attempting to sell accounts or content
• Use of multiple devices beyond the permitted limit
• Abusive behaviour towards BrainBuzz Academy staff or faculty

17. Preservation and Disclosure

You acknowledge and agree that we may access, preserve and disclose your account information if required by law, or in a good-faith belief that such action is reasonably necessary to comply with legal process, enforce these Terms, respond to claims that content violates third-party rights, protect the rights, property or safety of the Company, its users and the public, or reach you for service or promotional purposes as per our Privacy Policy.

18. Security Components

The Platform includes security components and digital rights management (DRM) that protect digital materials. You shall not attempt to override, disable, circumvent or interfere with any security components, encryption or usage rules embedded in the Platform.

19. Proprietary Rights and Intellectual Property

• All material on the Platform — names, logos, trademarks, images, text, graphics, videos, questions, explanations, software and design elements — is protected by copyright, trademark and other intellectual property laws, and is owned or licensed by the Company.
• You are granted a revocable, limited, personal, non-exclusive and non-transferable licence to access the Platform and its content for personal, non-commercial use only.
• No material may be copied, reproduced, republished, sold, uploaded, posted, transmitted or distributed in any way without our prior written permission.
• You may not add to, delete, distort or otherwise modify the material. Any unauthorised attempt to modify material or defeat security features is strictly prohibited and will result in account blockage or other action we deem fit.

20. Third-Party Content and Links

Faculty and content contributors may be independent third parties; the professional and technical information in their content is their responsibility, and while we review content on a best-effort basis, we disclaim warranties as to its completeness or currency. The Platform may contain links to third-party websites or apps. We are not responsible for their content, products or policies. Accessing any third-party platform is at your own risk, and such links do not constitute our endorsement.

21. Disclaimer of Warranties and Limitation of Liability

The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Platform will be constantly available, or that the information on it is complete, true or accurate. We shall not be liable for any interference, virus, hacking or failure caused by network providers, internet services or device manufacturers.

We are not responsible for any data you lose while accessing the Services; you are responsible for backing up your own data. We are not liable for delays or failures arising from causes beyond our reasonable control.

SUBJECT TO APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF BRAINBUZZ ACADEMY, ITS EMPLOYEES, AGENTS, PARTNERS AND CONTRACTORS, ARISING FROM OR RELATED TO THE SERVICES, EXCEED THE PAYMENTS ACTUALLY RECEIVED AND RETAINED BY US FROM YOU. IF YOU ARE NOT A SUBSCRIBED USER, WE WILL NOT BE LIABLE TO YOU UNDER ANY CIRCUMSTANCES.

22. Indemnity

You agree to defend, indemnify and hold harmless the Company, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents from and against all claims, damages, obligations, losses, liabilities, costs and expenses (including attorneys' fees) arising from: your use of and access to the Platform; third-party claims relying on your representations based on our Services; your violation of these Terms or the Privacy Policy; or your violation of any third-party right, including intellectual property or privacy rights.

23. Exclusions and Limitations

The Platform and Services are intended for use within the jurisdiction of India only. Users accessing the Platform from other jurisdictions do so at their own volition and are responsible for compliance with local laws. Where certain limitations of liability are not permitted in a jurisdiction, the remaining provisions of these Terms remain in full force.

24. Term and Termination

• These Terms remain in effect for as long as you use the Platform. You may terminate your subscription at any time by contacting our support team; however, no refunds are offered for termination or discontinuation by you except as provided in the Refund Policy.
• We may terminate or suspend your account or access to the Platform immediately, with or without notice and without liability, if we believe you have breached these Terms or the Privacy Policy, provided false information, or interfered with other users' use of the Platform.
• Provisions which by their nature should survive termination (including intellectual property, limitation of liability and indemnity) shall survive.

25. Additional Terms

• We reserve the right at any time to modify, edit, delete, suspend or discontinue the Platform or any portion of it, temporarily or permanently, with or without notice, without liability to you.
• These Terms and the rights granted hereunder may not be transferred or assigned by you, but may be assigned by us without restriction.
• These Terms, together with the Privacy Policy, Refund Policy and pricing details published on the Platform, constitute the entire agreement between you and the Company regarding the Platform, superseding any prior agreements.
• Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• If any provision of these Terms is held invalid or unenforceable, that provision shall be applied with the minimum modification necessary to make it valid, and the remaining provisions shall remain in full force and effect.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Andhra Pradesh, India. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.
